Please read these Terms of Service carefully before using the South Winds website or purchasing tickets or products. By accessing or using our platform, you agree to be bound by these Terms.
1. About Southwinds
Southwinds ("we", "us", "our") is an event organizer and ticket platform that hosts private events, social gatherings, and organized excursions. Our website allows users to purchase tickets to Events and consumable products associated with those Events.
These Terms of Service govern your use of our website, your account, ticket purchases, and participation in our Events. Attendance at Events is also subject to our Event Terms & Liability Waiver, which is incorporated herein by reference.
2. Eligibility
- You must be at least 18 years of age to create an account and purchase tickets. By using our platform, you represent that you are at least 18 years old.
- You must provide accurate, complete, and up-to-date information when creating your account.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- We reserve the right to suspend or terminate your account at any time for any violation of these Terms.
3. Ticket Purchases
- Pricing: All ticket prices are displayed on the Event listing page and are subject to change before purchase. Prices are final at the time of checkout.
- Payment: Payment is processed securely through PayPal. By completing a purchase, you authorize the charge to your selected payment method.
- Ticket validity: A Ticket is valid only for the specific Event for which it was purchased and for the named account holder. Tickets may not be resold, transferred, or used by anyone other than the registered account holder without our written consent.
- Ticket linkage:Your Ticket will be linked to your Southwinds account and accessible from your account dashboard. A QR code will be available after you accept the Event Terms & Liability Waiver. This QR code serves as your entry credential at the Event.
- Entry: We reserve the right to deny entry to any person whose Ticket cannot be verified, who has violated these Terms, or who presents a risk to the safety or integrity of the Event.
4. Cancellations & Refunds
- Participant cancellation: Refund eligibility depends on the specific Event's refund policy, which is displayed at the time of purchase. In general, cancellations made more than 72 hours before the Event may be eligible for a partial or full refund. Cancellations within 72 hours of the Event are non-refundable unless otherwise specified.
- Event cancellation by Organizer: If we cancel an Event, you will receive a full refund of the Ticket purchase price. We are not liable for any additional losses, including travel or accommodation costs.
- Event changes: We reserve the right to modify Event details (date, time, venue, lineup) at any time. Material changes will be communicated via email. Minor changes do not entitle you to a refund.
- No refunds for removal: If you are removed from an Event for violating these Terms, the Event Terms, or the Code of Conduct, no refund will be issued.
- Force Majeure: In the event of circumstances beyond our control (weather, governmental action, public health emergency, etc.), we reserve the right to cancel or reschedule the Event. Refunds or credits will be offered at our discretion.
5. Wristband & In-Event Purchases
Upon entry to an Event, you will receive a Wristband linked to your account. This Wristband enables you to purchase food, beverages, and other consumables at the Event. For complete details on the Wristband system, please refer to our Event Terms & Liability Waiver.
- All Wristband purchases are final. No refunds on consumables.
- You are responsible for all charges made with your Wristband.
- Payment for Wristband charges can be made in advance via the website or at the Event exit point.
- Outstanding Wristband balances may be charged to your account or payment method on file.
6. User Conduct
When using our platform, you agree not to:
- Provide false or misleading information;
- Impersonate another person or entity;
- Purchase tickets on behalf of another person using false information;
- Attempt to gain unauthorized access to any part of the platform;
- Use automated means to access, scrape, or collect data from our platform;
- Resell or transfer tickets without our express written authorization;
- Engage in any activity that interferes with or disrupts the platform.
7. Intellectual Property
All content on the Southwinds website — including text, graphics, logos, images, videos, and software — is the property of Southwinds or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.
8. Privacy
Your use of our platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
9. Disclaimer of Warranties
The Southwinds platform and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or harmful components. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Southwinds and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or attendance at Events. Our total liability shall not exceed the amount you paid for the Ticket in question.
11. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the platform following changes constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Southwinds operates. Any disputes shall be resolved through good-faith negotiation and, if necessary, through the competent courts of the applicable jurisdiction.
